FOR THE TINY STARS RAFFLE

By purchasing a raffle ticket, you agree to these Official Rules. You must be at least 18 years of age to purchase a ticket or win a prize. Void where prohibited by law. Raffle tickets are $20 each.

No more than 5,000 tickets will be sold. Raffle tickets must be purchased no later than 5:00 p.m. on May 20, 2010. Only one name may be entered on a ticket. Division of a prize by a group purchasing a ticket shall be the sole responsibility of the person named as the winner. Raffle tickets may NOT be purchased in the name of a business, trust, corporation or any other entity. Altered tickets will be automatically disqualified. No refunds shall be given. Coupon may be used for one or all sponsors.

Purchases of raffle tickets are NOT tax-deductible contributions. The IRS states that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not deemed as donations or gifts and consequently do not qualify as deductible charitable donations.

PRIZES

GRAND PRIZE DRAWING

Custom 1955 Porsche Spyder 550 James Dean Replica or Speedster Replica:

Prize value must total an amount equal to or lesser than Thirty Thousand Dollars ($30,000). The agreement for the design of custom Porsche Spyder 1955 James Dean replica or the Speedster replica (herein referred to as vehicle) will be the solely between FiberSteel, Inc. (herein referred to as designer) and the winner. Should the total amount of the vehicle after taxes, fees or any other expense incurred during the design process be greater than Thirty Thousand Dollars ($30,000) is the sole responsibility of the winner. The winner agrees to take possession of the vehicle from the designer on the date specified by and between the designer and the winner. The designer agrees to make arrangements for delivery of vehicle (if applicable) as specified by the winner. Tiny Stars will not be held responsible for any monetary balances due in excess of Thirty Thousand Dollars ($30,000), including any added features, tax, title, license, insurance or any other fees. The aforementioned fees are the sole responsibility of the winner. Tiny Stars shall not be held responsible for claims, misrepresentations, loss, damage, or any grievances between the designer and the winner. Due to the optional features chosen by the winner, the actual vehicle received may differ from the vehicle shown in any publication in connection with this raffle. There is no limit on how many tickets one person can purchase.

FiberSteel, Inc. has agreed to allow ticket purchasers a special, discounted price on any vehicle designed by FiberSteel, Inc.

20 ticket purchasers drawing: Costa Rica Trip

Purchasing tickets in increments of Twenty (20) will earn the purchaser one (1) entry into the special drawing for the t rip to Costa Rica to be held on the same day an time as specified for the Grand Prize drawing. If fewer than two (2) tickets are entered, the drawing will become null and void. There is no limit on how many tickets one person can purchase and examples are as follows:

Purchase 20 Grand Prize tickets = 1 entry into Costa Rica drawing
Purchase 40 Grand Prize tickets= 2 entries into Costa Rica Drawing
And so on.

The winning ticket will receive courtesy of Safari Surf School (herein referred to as SSS) in Costa Rica:
RT transport from international airport to Nosara & back
3 Nights & 4 days accommodations at the Harmony
Hotel (double occupancy)... Daily full breakfast
2 surf lessons per day with all equipment provided OR
Daily surf guide
(1) Full body massage per person
(2) Yoga classes per person
Ticket purchasers can redeem the ticket for a 5% discount on any SSS package and a 10% donation to Tiny Stars program. Grand prize includes amenities as stated above, however all other expenses such as food, travel while in Costa Rica and other expenses are the sole responsibility of the Grand Prize winner. Tiny Stars and Surf Safari School assume no responsibility for injury, loss or damage of luggage or any other loss, damage or mishaps that may occur.

Purchasing Ten (10) Grand Prize tickets will earn the purchaser one (1) entry into the special drawing for the paragliding adventure to be held on the same day and time as specified for the Grand Prize drawing. Winner of this drawing will receive two (2) twelve (12) minute paragliding rides that can be used by 1 or 2 individual(s). Ticket purchasers can redeem the ticket for a 5% discount on any paragliding package and a 10% donation to Tiny Stars program.

Multiple Ticket Purchases

There is no limit on how many tickets one person can purchase.

Purchasing 35 tickets will enter the purchaser into the drawings for all Four (4) prizes- 20 tickets entered for Grand Prize, 1 ticket entered for Costa Rica trip, 1 ticket entered for paragliding adventure and 1 ticket entered for skydiving adventure.

Purchasing 30 tickets will enter the purchaser into the drawings for Three (3) prizes- 20 tickets entered for Grand Prize, 1 ticket entered for Costa Rica trip and 1 ticket entered for paragliding adventure.

Purchasing 25 tickets will enter the purchaser into the drawings for Three (3) prizes- 20 tickets entered for Grand Prize, 1 ticket entered for Costa Rica trip and 1 ticket entered for skydiving adventure.

However, the aforementioned combinations are the only combinations allowed. If you wish more than one (1) entry into a specific drawing, tickets must be purchased in separate transactions that are concurrent. Example, we will not allow a substitution for two (2) entries into the skydiving trip for the purchase of 30 tickets {i.e. 20 grand prize entries, 2 skydiving entries.} UNLESS the remaining Five (5) tickets are purchased in a separate transaction and this is specified on the ticket where the information for number sold is entered.
Multiple ticket purchaser eligibility is subject to the following conditions: 1) any two or more tickets that are purchased at any time during the bonus drawing sale period and are filled out with IDENTICAL NAMES, PHONE NUMBERS AND E-MAIL ADDRESSES, and 2) all such ticket orders with full valid payment received by 5:00pm, October 20, 2009.

Ineligibility & Disqualification

Tiny Stars does not assume responsibility if the winner is not able to take receipt of any prize listed. The winner of the vehicle must possess a valid drivers’ license, insurance and comply with any other requirement made by the law to accept such a prize. Tiny Stars is not responsible if the winner is unable to legally travel to Surf Safari School in Costa Rica. The winner(s) of both the paragliding and skydiving trips must meet the requirements as set forth by the companies offering said activities. This can include but is not limited to health, weight, age (ex. over age 18), completed training or any other safety requirement. Tax authorities may place a different value on the prize for the purposes of determining any income, transfer or other taxes that may be due from the Prize winner. The winner of the Prize is responsible for all fees, local, state and federal taxes, insurance, sales, and use taxes. Payment or withholding of applicable taxes and fees will be required at the time of transfer of the prize to the winner.

If fewer than 3,000 tickets have been sold on or before 5:00 p.m. on October 20, 2009, the Grand Prize will be a cash prize equal to 50% or one-half of the total proceeds of the ticket sales less expenses incurred by Tiny Stars. However, those who were entered into any one of the multiple ticket purchasers drawing will be awarded their prize.

Winners are responsible for all fees, local, state and federal taxes, and any other taxes and fees payable as a result of winning a prize. Payment or withholding of applicable taxes and fees will be required at the time of transfer of the prize to the winner.

SELECTION OF WINNERS & ODDS OF WINNING

Winning tickets will be drawn at random on October 20, 2009 unless extended by Tiny Stars. Ticket purchaser does not have to be present to win. If all 5,000 tickets are sold, the odds of winning the Grand Prize Drawing Event will be 1 in 5,000. Odds will improve if fewer tickets are sold. Odds of winning any prize will depend on the number of eligible raffle tickets sold by the applicable deadline. All prizes will be awarded as specified in respect to each prize. All prize winners will be contacted directly by both the phone and e-mail addresses listed on the winning ticket and will also be listed on the Tiny Stars website for at least 30 days after the drawing date. If, however, any winner cannot be located within 15 days after the drawing, after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited his or her prize and alternative winners will not be drawn. A list of winners may be obtained by sending a self addressed stamped envelope to the Tiny Stars. Requests in writing must be received by December 31, 2009.

EXTENSIONS OF DEADLINES & DRAWING DATES

Tiny Stars reserves the right to extend all entry deadlines and drawing dates at its sole discretion. Tiny Stars will post a notice on its Website at www.tinystars.org if it is extending any entry deadlines or drawing dates.

GENERAL TERMS AND CONDITIONS

By purchasing a raffle ticket, you agree to be bound by these Official Rules and the decisions of Tiny Stars, which shall be final. Winners will be required to execute an affidavit of eligibility and a publicity and appearance release permitting Tiny Stars to use their name, photograph, likeness and voice for promotional purposes in any media. All winners are required to present proof of identity satisfactory to Tiny Stars in Tiny Stars sole discretion, matching the name on the winning ticket. Tiny Stars is not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of any prize. Winner agrees to indemnify, defend (with counsel acceptable to Tiny Stars) and hold Tiny Stars and each of their respective officers, directors, shareholders, employees, agents and affiliated entities, harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of the prize.
